Terms of Service

Agreement

These Terms govern your use of StemStash, operated by Dave Nunes. By creating an account or otherwise using StemStash, you agree to them. If you do not agree, do not use the service.

The service

StemStash analyzes audio stems you upload: classifying instrument type, detecting BPM and musical key, and flagging likely-silent takes, then returning a reorganized, renamed copy for download. This analysis is deterministic local audio processing, not a generative AI service and not a per-file call to a third-party model.

Detection is not guaranteed to be perfect. Every result is shown with a confidence score and can be reviewed and corrected before you export. You are responsible for having the rights to any audio you upload; see Acceptable use below.

Accounts

You need an account to use StemStash. You are responsible for keeping your login credentials secure and for activity that happens under your account. Tell us at support@davenunes.com if you suspect unauthorized access to your account.

Acceptable use

You are responsible for having the rights to any audio you upload. You agree that you will:

• only upload audio you own or are otherwise authorized to process;
• not upload content that is unlawful, infringes the rights of others, or contains malware;
• not attempt to disrupt, reverse-engineer, or abuse the service, including circumventing credit limits or automating account creation to obtain credits you have not paid for.

We may suspend or terminate accounts that violate this section; see Termination below.

Credits and billing

There is no free tier: processing a file requires an active subscription plan or a purchased credit balance.

One credit is consumed for each stem that finishes processing successfully. A stem that fails to process, or a job that is cancelled, does not consume a credit.

Subscriptions and one-time credit purchases are billed through Stripe. Current pricing and included credits are shown at checkout and on your Account page. You can cancel a subscription at any time; cancellation takes effect at the end of the current billing period, and we do not provide prorated refunds for the remainder of a period.

Because credits are only spent on successful processing, most billing problems are prevented automatically. If you believe you were charged in error, contact support@davenunes.com and we will look into it.

Availability

Processing and export are automated and, like any software system, may occasionally fail, be delayed, or be temporarily unavailable for maintenance; failed jobs do not settle credits for files that were not successfully processed. We do not guarantee uninterrupted access or a specific uptime, and the service is provided on an as-is, as-available basis, without warranties of any kind, express or implied.

You are responsible for keeping your own copy of original audio files before you upload them. Storage on StemStash is temporary (see the Privacy Policy) and is not a backup service.

Limitation of liability

To the maximum extent permitted by law, StemStash and Dave Nunes are not liable for indirect, incidental, or consequential damages arising from your use of the service, including loss of data. Total liability for any claim relating to StemStash is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these Terms limits liability where the law does not allow it to be limited.

Termination

You can stop using StemStash and close your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms.

If we terminate your account for a reason other than your own breach of these Terms, we will refund any unused purchased credit balance; otherwise, unused credits are not refunded on account closure. In every case, your uploaded stems and exports are deleted according to the retention rules in the Privacy Policy.

Governing law

These Terms are governed by the laws of the Netherlands. If you are a consumer resident in the European Union, this does not remove any mandatory consumer-protection rights your local law gives you. Disputes not resolved informally may be brought before the competent Dutch courts.

Changes to these terms

We may update these Terms as StemStash evolves. We will update the date above when we do, and communicate material changes to you where appropriate. Continuing to use StemStash after a change means you accept the updated Terms.
